1.1    You may use the Website to gain access to Advanced Details “Details” owned and published by AD or our partners, other information (“Information”) owned and published by AD and other content (“Content”).

1.2    You acknowledge that, at any time, the Details, Information and Content access thereto are subject to conditions that AD might  apply and that for the purposes of the Terms Details, Information and Content include images, CAD and IFC files.

1.3    We endeavour to provide Details, Information and Content on the Website that is accurate, current and complete, but we do not guarantee them in those respects, and it is your responsibility to check the accuracy of the Details, Information and Content before taking or refraining from any action based upon them.

2.    Liability

2.1    AD makes no warranties, representations or undertakings in respect of the operation of the Website, the Details, Information and Content (including, without limitation, as to its accuracy, quality, completeness and/ or fitness for any purpose), the services referred to on the Website and/or any content of any other website linked to it.

2.2    In no event will AD be liable for any loss or damage including, without limitation, direct, indirect, special, incidental or consequential loss or damage arising from the use of the Website or use of or reliance on the information presented on the Website, whether based on warranty, contract, tort or any other legal grounds.

2.3    It remains Your responsibility to ensure that any building in which AD Details or other Content is used is compliant with the prevailing building regulations or codes. AD Details is intended to facilitate compliance with regulations or codes but no guarantee to this effect is offered or implied. In particular, You must verify that Your design, whether or not it incorporates or makes reference to AD Content, must be suitable in terms of structural safety, resistance to fire, noise, moisture and contaminants, and the conservation of fuel and power, Health and Safety, Construction Design Management, and any other relevant regulation, legislation or risk.

3.    Copyright and Intellectual Property

3.1    The Website, Details, Information and Content is protected by copyright, and AD owns such copyright, unless stated to the contrary by AD in writing.

3.2    Subject to this clause 3 and the other obligations upon you contained in these Terms, AD grants and you accept a non-exclusive, non-transferable licence to access and use the Website (including any of the Details) for the purpose of your own personal use and/ or your own internal business purposes.

3.3    The Trade Marks, Logos, and Service Marks ("Marks") displayed on the Website (including, without limitation, on the Details) are the property of AD or other third parties. You are not permitted to use the Marks without the prior written consent of AD or such third party that may own the Marks.

4.    Restrictions

4.1    You may copy Website Content to a local hard disk and print extracts of Website Content for your own personal use and/ or your own internal business purposes (as appropriate).

4.2    If a copy of any part of the Website Content is being passed to a third party, AD’s intellectual property rights must be acknowledged, the third party must be informed of these Terms and agree to be bound by them, and the supply of such Website Content must not be for commercial purposes or gain.

4.3    You may not copy systematically or undertake any other downloading of material with a view to commercial use or avoidance of our service charges.

4.4    Copying of Website Details, Information and Content is permitted only in accordance with these Terms. You may not otherwise copy, reproduce, distribute, edit or amend them or otherwise incorporate them into any other publication or work in any form of media. Any request to copy them outside the scope of the licence granted in these Terms should be made via the Feedback button. AD reserves its right to refuse to grant any such request.

 

5.    Information Service Provision

5.1    The Website is intended normally to be available at all times. AD will not be liable for any failure to achieve this level of availability.

5.2    The Website may be suspended temporarily and without notice in circumstances of system failure, maintenance or repair and for other reasons.

5.3    You agree that AD may, in its sole discretion, at any time terminate or restrict your access to the Website.

10.2    If any provision of these Terms is held to be void or unenforceable in whole or in part, the Terms shall continue to be valid as to all other provisions and the remainder of the affected provision.

10.3    The Website services are provided from England, irrespective of your location.

10.4    None of the provisions of these Terms are intended to or will operate to confer any benefit pursuant to the Contracts (Rights of Third Parties) Act 1999 on a person who is not a user of this Website.

10.5     These Terms represent the whole agreement and understanding between AD and you in respect of the matters referred to herein and shall, except in the case of fraud, override, and no reliance shall be placed upon, any other verbal or written representations, warranties or understandings in respect of the subject matter of these Terms.

11.    Governing Law

These Terms are governed by English law and each party to these Terms submits to the exclusive jurisdiction of the English courts.
